The purpose of the automated collection and processing of personal data is to maintain the business relationship and to carry out information, training, consulting and other activities of Tatiana Borisova.

These data will only be transferred to public administrations and collaborating entities with the sole objective of fulfilling the purpose stated above.

How long is the personal data collected kept?

Data retention in accordance with the LSSI

Tatiana Borisova informs that, as a provider of data hosting services and pursuant to the provisions of Law 34/2002 of 11 July on Information Society Services and Electronic Commerce (LSSI), it retains for a maximum period of 12 months the information essential to identify the origin of the hosted data and the time when the provision of the service began. The retention of this data does not affect the confidentiality of communications and may only be used within the framework of a criminal investigation or to safeguard public safety, being made available to judges and/or courts or the Ministry that so requires.

The communication of data to the State Forces and Corps will be carried out in accordance with the provisions of the regulations on the protection of personal data.

Intellectual property rights

Tatiana Borisova is the owner of all copyrights, intellectual and industrial property, know-how and any other rights related to the contents of the website www.borisovaerpconsulting.com and the services offered therein, as well as the programs necessary for its implementation and related information.

Reproduction, publication and/or non-strictly private use of the contents, in whole or in part, of the website www.borisovaerpconsulting.com is not permitted without prior written consent.

Intellectual property of software

The user must respect third-party programs made available to him by Tatiana Borisova, even if they are free and/or publicly available.

Tatiana Borisova has the necessary intellectual property and exploitation rights to the software.

The user does not acquire any right or license for the contracted service, over the software necessary for the provision of the service, nor over the technical information for monitoring the service, except for the rights and licenses necessary for the fulfillment of the contracted services and only for the duration of the same.

For any action that exceeds the fulfillment of the contract, the user will need written authorization from Tatiana Borisova, and the user is prohibited from accessing, modifying, viewing the configuration, structure and files of the servers owned by Tatiana Borisova, assuming civil and criminal liability arising from any incident that may occur on the servers and security systems as a direct consequence of negligent or malicious action on his part.

Intellectual property of the hosted content

Any use of the services provided by Tatiana Borisova, and in particular of the following, in violation of intellectual property law, is prohibited:

• Any use that is contrary to Spanish laws or that infringes the rights of third parties.
• The publication or transmission of any content that, in the opinion of Tatiana Borisova and his team, is violent, obscene, abusive, illegal, racial, xenophobic, defamatory or that violates the political, religious, ideological and sexual freedom of individuals.
• Cracks, serial numbers for programs or any other content that infringes the intellectual property rights of third parties.
• The collection and/or use of personal data of other users without their express consent or in contravention of the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data.
• Using the domain’s mail server and email addresses to send mass spam.

The user bears full responsibility for published comments, transmitted and stored information, hypertext links, third party claims and legal actions regarding intellectual property, third party rights and protection of minors.

The user is responsible for the laws and regulations in force and the rules that relate to the operation of the online service, electronic commerce, copyright, maintenance of public order, as well as universal principles of Internet use.

The User shall indentify Tatiana Borisova for any costs arising from any prosecution in any case for which the User is responsible, including legal fees and costs, even in the event of a non-final court decision.

Protection of hosted information

Tatiana Borisova makes backup copies of the content hosted on its servers, however it is not responsible for the loss or accidental deletion of data by users. Likewise, it does not guarantee the complete replacement of data deleted by users, since the aforementioned data could have been deleted and/or modified during the period of time elapsed since the last backup.

The services offered do not include the maintenance of user content on Tatiana Borisova’s computer assets, and therefore do not include the replacement of content stored in backup copies made by Tatiana Borisova, regardless of the reason for its loss; therefore, if recovery by the user is necessary, a fee will be determined according to the complexity and volume of the recovery, always subject to prior acceptance by the user.

Data recovery is not included in the price of any of the services offered by Tatiana Borisova, as her activity is not related to data hosting.

Commercial communications

In accordance with the LSSI, Tatiana Borisova will not send advertising or promotional communications by email or other equivalent means of electronic communication that have not previously been requested or expressly authorized by the recipients thereof.

In the case of users with whom there is a prior contractual relationship, Tatiana Borisova is authorized to send commercial communications regarding products or services that are similar to those that were initially contracted with the client.

In any case, the user, after proving his or her identity, may request that no further commercial information be sent to him or her through the Customer Service channels.
